Do states have the right to prevent potential immigrants from crossing their borders, or should people have the freedom to migrate and settle wherever they wish? Christopher Heath Wellman and Phillip Cole develop and defend opposing answers to this timely and important question.

The mass movement of people across the globe constitutes a major feature of world politics today. -/- Whatever the cause of the movement - often war, famine, economic hardship, political repression or climate change - the governments of western capitalist states see this 'torrent of people in flight' as a serious threat to their stability and the scale of this migration indicates a need for a radical re-thinking of both political theory and practice, for the sake of political, social and (...) economic justice. -/- This book argues that there is at present a serious gap between the legal and social practices of immigration and naturalisation in liberal democratic states and any theoretical justification for such practices that can be made within the tradition of liberal political philosophy. How can liberal states develop institutions of democratic citizenship and at the same time justifiably exclude 'outsiders' from participating in those institutions? The book examines various responses to this contradiction within the liberal tradition, and finds none of them satisfactory - there are no consistently liberal justifications for immigration control and this has serious implications both for liberal practice and theory. How far does a researcher’s responsibility extend when an incidental finding is identified? Balancing pertinent ethical principles such as beneficence, respect for persons, and duty to rescue is not always straightforward, particularly in neuroimaging research where empirical data that might help guide decision making are lacking. We conducted a systematic survey of perceptions and preferences of 396 investigators, research participants, and Institutional Review Board members at our institution. Using the partial entrustment model as described by Richardson, we argue that our (...) data supports universal reading by a neuroradiologist of all research MRI scans for incidental findings and providing full disclosure to all participants. A body of work has emerged in political philosophy which can be termed ‘the ethics of migration’. Within that literature, there has been an increased focus on issues of displacement and protection...

In December 2007 it was revealed that the British government is considering the exclusion of certain groups of migrants—those considered to be present “illegally”—from primary health care provided by the National Health Service. At present, practitioners have discretion to accept any individual for NHS treatment regardless of their status. A joint Home Office and Department of Health review is examining this access for foreign nationals, and the likely outcome is the restriction of access to irregular migrants, which would, according to (...) the Institute of Public Policy Research, affect around 390,000 people. In 2004 such groups were excluded from NHS secondary care, most controversially from treatment for HIV, and so the present proposal would bar them from all but emergency health treatment. (shrink)

ABSTRACT Liberal political philosophy has little of interest to say about the social liberty of the physically disabled. It accepts that the physically disabled and the able‐bodied are equally at liberty, even though the former can do far less than the latter; and it concludes that there are no interesting political statements we can make about their situation. In this essay, I assume that the physically disabled are unfree, not merely unable, to use public facilities which do not take their (...) disability into account, thereby excluding them. I criticise liberal theories of liberty by exposing and questioning the assumptions which entail the liberal theorist's rejecting this claim. I conclude that there is a form of negative liberty which does enable the liberal theorist to make political statements about the freedom of the disabled [1]. (shrink)

In this essay, I examine the concept of the refugee within the context of liberal political theory. The argument is that the refugee is displaced both in political practice and political theory – theory has a topology, and inside and an outside, such that even if the refugee as a concept does enter within its boundaries it does so as a marginal figure, constructed as problematic. However, liberal political also has a topography when it comes to the refugee question – (...) it is not just insider theory, but theory constructed within a particular kind of state in a particular location in the world. This means the extent to which liberal political theory can answer the refugee question is limited. The main challenge for theory, I argue, is not to come up with an answer to the refugee question, but to construct a context within which the refugee is an equal participant in the process of arriving at an answer. In this paper I re-state the egalitarian argument against the morality of immigration controls: such limits violate the central ethical commitment to moral equality. This means that immigration controls fail a fundamental moral test and represent the ethical failure of the liberal project of moral equality. I set this re-statement against recent arguments about what moral equality means, specifically Christopher Heath Wellman's use of Elizabeth Anderson's notion of relational equality. Wellman believes that Anderson's ideas seriously damage the egalitarian argument, but (...) I argue that this is a misreading of her account. I conclude that any liberal attempt to morally justify immigration controls must fail through committing the basic logical error of ‘begging the question’. (shrink)

The idea of the “nation” has played only a small role in modern political philosophy because of its apparent irrationalism and amoralism. David Miller, however, sets out to show that these charges can be overcome: nationality is a rational element of one’s cultural identity, and nations are genuinely ethical communities. In this paper I argue that his project fails. The defence against the charge of irrationalism fails because Miller works within a framework of ethical particularism which leads to a position (...) of metaethical relativism. A consequence of this relativism is that a community’s moral principles and boundaries of exclusion cannot be rationally justified to those constructed as “outsiders”. The defence against the charge of amoralism fails because Miller does not so much provide an argument to show that nations are ethical communities as assume they are; we are therefore left without resources to discriminate between ethical and unethical nations. I apply these problems to Miller’s treatment of the question of immigration, arguing that it shows that his version of “liberal” nationalism has a tendency to collapse towards a conservative position on such issues. This should not give us any great confidence that the nation, as Miller presents it, should be embraced by modern political philosophy. (shrink)

In response to the need for a more diverse workforce, our medical school developed new policies and procedures that focus on the recruitment and selection of diverse students with a specific focus on those considered underrepresented in medicine. To understand what these students bring to the practice of medicine, researchers investigated their perception of their cultural assets and how they plan to use these assets as physicians. A cross-section of 23 ethnically, culturally, and geographically diverse medical students were interviewed and (...) data were analyzed through phenomenographical methods. The results indicate that students view themselves as having multiple assets that could be of significant value in their future practice of medicine, including: a) an interest in science and access to family members in medicine, b) personal and familial struggles with health, c) self and family as immigrants, and d) strong family and community orientations. Students perceived these as cultural assets because they could directly identify where these assets could be valuable in medicine but questioned how to maintain them throughout medical school. Now that our institution has identified these assets, next steps include administrators' investigation of ways to leverage them through curricular and educational programs. (shrink)

The escalation of violence committed by the Revolutionary Armed Forces of Colombia guerrillas against noncombatant civilians triggered a shift in the theoretical orientation of scholars who study Colombia’s political economy. While previous explanations emphasized the sociopolitical “grievances” underlying guerrilla activities, recent explanations emphasize the “greed” motive, including guerrilla involvement in Colombia’s illegal narcotics trade. In this article, the author posits an alternative explanation using Charles Tilly’s theories of state formation to explain FARC activities in Caquetá, Colombia. Drawing from a longitudinal (...) data set that documents the war making, state making, extraction, and protection activities of the FARC between 1975 and 2007, in addition to historical sociological methods, the author finds that increases in FARC repression stem from the growing militarization and paramilitarization of the region, which pressured the FARC to extract resources from the local population in a way that no longer served that population’s legitimate protection interests. In this chapter, I evaluate various conceptions of distance. Of the two most prominent, one takes distance relations to be intrinsic, the other extrinsic. I recommend pluralism: different conceptions can peacefully coexist as long as each holds sway over a distinct region of logical space. But when one asks which conception holds sway at the actual world, one conception stands out. It is the conception of distance embodied in differential geometry, what I call the Gaussian conception. On this conception, all (...) fundamental facts about distance are “local” facts.” But there is a problem: the Gaussian conception, notwithstanding its mathematical and physical credentials, appears metaphysically suspicious on Humean grounds. In the final section, I suggest that the Gaussian conception can be given a sound metaphysical footing in terms of non-standard analysis. (shrink)

Stephen Cole Kleene was one of the greatest logicians of the twentieth century and this book is the influential textbook he wrote to teach the subject to the next generation. It was first published in 1952, some twenty years after the publication of Godel's paper on the incompleteness of arithmetic, which marked, if not the beginning of modern logic. The 1930s was a time of creativity and ferment in the subject, when the notion of computable moved from the realm (...) of philosophical speculation to the realm of science. This was accomplished by the work of Kurt Gode1, Alan Turing, and Alonzo Church, who gave three apparently different precise definitions of computable. When they all turned out to be equivalent, there was a collective realization that this was indeed the right notion. Kleene played a key role in this process. One could say that he was there at the beginning of modern logic. He showed the equivalence of lambda calculus with Turing machines and with Godel's recursion equations, and developed the modern machinery of partial recursive functions. This textbook played an invaluable part in educating the logicians of the present. It played an important role in their own logical education.". (shrink)

According to David Lewis, a realist about possible worlds must hold that actuality is relative: the worlds are ontologically all on a par; the actual and the merely possible differ, not absolutely, but in how they relate to us. Call this 'Lewisian realism'. The alternative, 'Leibnizian realism', holds that actuality is an absolute property that marks a distinction in ontological status. Lewis presents two arguments against Leibnizian realism. First, he argues that the Leibnizian realist cannot account for the contingency of (...) actuality. Second, he argues that the Leibnizian realist cannot explain why skepticism about one's own actuality is absurd. In this paper, I mount a defense of Leibnizian realism. (shrink)

This paper considers pick-the-winners contests as a simple method for harnessing the wisdom of crowds to produce probability forecasts. Pick-the-winners contests are those in which players pick the outcomes of selected future binary events with a prize going to the player with the most correct picks. In contrast to soliciting probability forecasts from experts, this paper shows that competition among players is to be encouraged because it improves the accuracy of the resulting crowd probability forecasts. This improvement comes because the (...) competition not only discourages the overbetting of favorites that occurs if prizes are awarded based on absolute performance, but also helps mitigate the public knowledge bias that occurs if everyone reports truthfully. In addition to the theoretical arguments, the paper analyzes picks from 6 years of pick-the-winners contests involving hundreds of players and 1037 college lacrosse games to find that the crowd proportions outperformed two benchmark sets of probabilities. In this chapter, I survey what I call Lewisian approaches to modality: approaches that analyze modality in terms of concrete possible worlds and their parts. I take the following four theses to be characteristic of Lewisian approaches to modality. (1) There is no primitive modality. (2) There exists a plurality of concrete possible worlds. (3) Actuality is an indexical concept. (4) Modality de re is to be analyzed in terms of counterparts, not transworld identity. After an introductory section in which (...) I motivate analyzing modality in terms of possible worlds, I devote one section to each of these four theses. For each thesis, I take Lewis’s interpretation and defense as my starting point. I then consider and endorse alternative ways of accepting the thesis, some of which disagree substantially with Lewis’s interpretation or defense. Currently, there is no consensus guideline as to the type or degree of donor steatosis considered acceptable for liver transplantation, and little is known about local practices in this area. The aim of this survey (...) was to evaluate current clinical practices amongst liver transplant surgeons in Australia and New Zealand in the evaluation and use of steatotic donor livers in LT.Methods: An anonymous online twelve-question survey was emailed to all practicing LT surgeons in ANZ in January 2010.Results: The response rate was 83%. Estimated prevalence of steatosis in donor livers was between 40% and 60%. In determining suitability for LT, 90% of respondents reported rejecting organs with "severe" steatosis based on visual and palpation grounds alone. A total of 68% sought further histological assessment if the donor liver looked bad and there were risk factors for steatosis. The majority of respondents performed only one biopsy of the liver, using hematoxylin and eosin staining for fat assessment. There was wide variation in the upper limit of steatosis considered to be acceptable for LT. A total of 21% of respondents still considered microvesicular steatosis a risk factor for primary graft nonfunction.Conclusion: This survey highlights the significant variation in the appraisal and use of steatotic grafts by LT surgeons in ANZ. Accurate evaluation and judicious use of mild and moderately steatotic grafts is required if we are to utilize the available donor pool best.Keywords: liver transplantation, steatosis, fatty liver, organ donors. At the beginning of Republic 2 (358e–359b), Plato has Glaucon ascribe a social contract theory to Thrasymachus and ‘countless others’. This paper takes Glaucon’s description to refer both within the text to Thrasymachus’ views, and outside the text to a series of works, most of which have been lost, On Justice or On Law. It examines what is likely to be the earliest surviving work that presents a philosophical defence of law and justice against those who would prefer their opposites, (...) On Excellence by an anonymous author usually referred to as ‘Anonymus Iamblichi’; the views on these topics among the Socratics, including Crito, Simon the Cobbler, Aristippus of Cyrene, and Antisthenes; and Socrates’ debate with Hippias ‘On Justice’ in Xenophon’s Memorabilia (4.4.5–25). Its main contention is that the ‘countless others’ referred to by Glaucon points chiefly, but not solely, to the members of the circle of Socrates, who themselves espoused a range of views on justice and law, and their relations. By means of a comprehensive and penetrating examination of the main elements of Epicurean ethics, Phillip Mitsis forces us to reevaluate this widely misunderstood figure in the history of philosophy.

This volume contains eighteen papers, three with new postscripts, that were written over the past 35 years. Five of the papers have not been previously published. Together they provide a comprehensive account of modal reality—the realm of possible worlds—from a Humean perspective, with excursions into neighboring topics in metaphysics. Part 1 sketches an account of reality as a whole, both the mathematical and the modal, defending a form of plenitudinous realism: every consistent proposition is true of some portion of reality. (...) Part 2 presents and defends a realist theory of concrete possible worlds with an absolute ontological distinction between the actual and the merely possible. Part 3 presents and defends a Humean account of modal plenitude, formulating and endorsing principles of recombination, of plenitude of possible structures, and of plenitude of alien contents. Part 4 applies the Humean account to truthmaking, mereology, spacetime, and quantities. I argue that holding fast to Humean strictures leads to views that differ in radical ways from those put forth by contemporary metaphysicians. (shrink)

People may have open minds on whether a life-extending drug or technology is going to be developed before their sixties and may strongly desire that development. Do they therefore hope that it occurs? Do they hope for it in the substantive sense of “pinning their hopes” on the development? No, they do not. Hoping for a prospect in that sense certainly presupposes having an open mind on whether it will occur and having a desire for its occurrence. But, more crucially, (...) it means investing the prospect with a characteristic, galvanizing, and orientating role: it involves setting aside doubts about the possible nonoccurrence of the prospect and acting accordingly. This article offers a characterization of hope in that substantive sense and argues both that it can be rational and that it is ubiquitous. (shrink)

Recent research investigating the language–thought interface in the spatial domain points to representations of the horizontal and vertical dimensions that closely resemble those posited by Jeffery et al. However, the findings suggest that such representations, rather than being tied to navigation, may instead reflect more general properties of the perception of space.

The most commonly heard proposals for reducing possible worlds to language succumb to a simple cardinality argument: it can be shown that there are more possible worlds than there are linguistic entities provided by the proposal. In this paper, I show how the standard proposals can be generalized in a natural way so as to make better use of the resources available to them, and thereby circumvent the cardinality argument. Once it is seen just what the limitations are on these (...) more general proposals, it can be clearly seen where the real difficulty lies with any attempt to reduce possible worlds to language. Roughly, the difficulty is this: no actual language could have the descriptive resources needed to represent all the ways things might have been. I conclude by arguing that this same difficulty spells doom for any nominalist or conceptualist proposal for reducing possible worlds. (shrink)

There are at least two senses in which human beings can be called “naturally artificial”: being adapted for creation of and participation in niche constructed environments, and being adapted for creation of and participation in such environments despite an exceptional indeterminacy in the details of the niche constructed environments themselves. The former puts human beings in a common category with many niche-constructing organisms while the latter is arguably distinctive of our species. I explain how this can be so by developing (...) an account of supporting concepts of complexity, contingency, and content-openness, and show how to defend the position against a common style of objection by a single comparative case study: hermit crabs and their shells versus humans and their movable dwellings. Finally, I consider evidence that such a feature is indeed species-typical and evolved in human populations. (shrink)

This paper is a critical study of Christians among the Virtues: Theological Conversations with Ancient and Modern Ethics by Stanley Hauerwas and Charles Pinches. It has four parts. First, I consider several possible responses to G. E. M. Anscombe’s famous challenge to modern moral philosophy in order to provide a framework in which the project of Hauerwas and Pinches can be located. Next I criticize their attempt to eliminate the realm of obligation from morality. Then I examine their treatment of (...) Martha Nussbaum’s work onAristotle in order to explore differences between secular and Christian appropriations of Aristotle. Finally, I discuss their views on the virtue of obedience and criticize their arguments against rival Kantian and divine command views. (shrink)

Arguments aimed at undermining certain accounts of the grounds of political obligations—no matter how successful they may be—fall far short of demonstrating that there are no such obligations. Doubts about the efficacy of these arguments in this latter regard seem even more justified when it is recognized that parallel lines of reasoning can be developed in the area of filial obligations , which arguments provide rather less than conclusive reasons for denying that there are filial obligations .Furthermore, we have good (...) reason to believe that there are political obligations if patriotism is a virtue, and also that patriotism is indeed a virtue. We therefore have a basis on which to affirm the existence of political obligations—a basis whose soundness is independent of the acceptability of particular accounts of the grounds of political obligation. Hence, even if standard accounts of the grounds of political obligations are problematic in certain respects, we should not regard this consideration as capable by itself of establishing that there are no such obligations. This article assesses to what extent the future of democratic liberty depends upon its citizens employing a proper approach to the past, by analyzing Tocqueville’s views of three kinds of historical consciousness—aristocratic, revolutionary, and democratic. It is argued that democracies require certain aristocratic assumptions about historical dynamics to cultivate a historical consciousness that fosters liberty. Key to this is the belief in the human capacity to influence the trajectory of history. Tocqueville’s historical approach, which blends aristocratic and democratic elements, is (...) identified as the most effective method for tempering the fatalistic tendencies of the democratic point of view. Thus, for democracies to maintain liberty, citizens should recognize the dual role of general causes and human agency in directing the course of historical events. Tocqueville’s insights on the effects of historical consciousness on the future of democratic liberty remain particularly relevant today when Western democracies confront internal polarization and external anti-democratic challenges, whether neoliberal, illiberal, populist, or fascist.
